Terms and Conditions

The following terms and conditions are issued by Australian Property Alliance Pty Ltd (Nicheliving) and apply to the Stamp Duty promotion being offered by Nicheliving (Promotion):
  1. This Promotion commences on 30th October 2019 and ends on 1st May 2020 (or such other date determined by Nicheliving in its absolute discretion) (Promotion Period).
  2. This Promotion applies in respect of contracts entered into during the Promotion Period (Eligible Contract) for the sale and purchase of the following categories of Nicheliving properties:
    (a) Nicheliving off-the-plan apartments for a new residential unit or apartment in a multi-tiered structure (being a vertical development other than a single-tier strata scheme as defined by section 3(1) of the Strata Titles Act 1985 (Off-the-plan Apartment); and
    (b) selected Nicheliving home and land packages as determined in Nicheliving’s absolute discretion as a property to which this Promotion applies and as confirmed in writing by Nicheliving to the Buyer at the date of entry into an Eligible Contract, (each an Eligible Property).
  3. The Promotion is available to the buyer of an Eligible Property under an Eligible Contract, if the buyer is a foreign person as defined by section 205A of the Duties Act 2008 (Eligible Buyer), then the promotion only applies to selected apartment dwellings and not house and land. (Eligible Buyer).
  4. The Promotion contemplates Nicheliving discounting the value of any Eligible Property under an Eligible Contract by an amount determined by reference to the transfer duty that would have been payable on the Eligible Contract based on the purchase price of the Eligible Property prior to any deduction made under this Promotion (Applicable Transfer Duty).
  5. The key terms of the Promotion are as follows:Nicheliving will, in respect of any Eligible Contract entered into for any Eligible Property by an Eligible Buyer, discount the purchase price of the Eligible Property by an amount equal to:

    i. Nicheliving will, in respect of any Eligible Contract entered into for any Eligible Property by an Eligible Buyer, discount the purchase price of the Eligible Property by an amount equal to:
    ii. 100% of the value of the Applicable Transfer Duty where the Eligible Property is an Off-the-plan Apartment and Nicheliving determines that the Eligible Buyer would not otherwise be eligible for an off-the-plan duty rebate offered by the Office of State Revenue in Western Australia; and
    iii. in all other cases, 25% of the Applicable Transfer Duty.
    iv. This maximum discount that Nicheliving will apply to any Eligible Property on account of the value of Applicable Transfer Duty is $10,000
  6. This Promotion does not apply in conjunction with any other offer made by Nicheliving or its related bodies corporate.

  13. These terms are governed by the laws of Western Australia.
NO STAMP DUTY PROMOTION
The following terms and conditions are issued by Australian Property Alliance Pty Ltd (Nicheliving) and apply to the Stamp Duty promotion being offered by Sky Homes Nicheliving (Promotion):
  1. This Promotion commences on 12th October 2021 and ends on 31st October 2021 (or such other date determined by Nicheliving in its absolute discretion) (Promotion Period).
  2. This Promotion applies in respect of contracts entered into during the Promotion Period (Eligible Contract) for the sale and purchase of a Sky Homes Nicheliving apartment off the plan.
  3. This Promotion is available to the buyer of an Eligible Property under an Eligible Contract (Eligible Buyer) who receives the State Government’s 75% Stamp Duty rebate, Nicheliving will cover the remaining 25% stamp duty payable.
  4. If the Eligible Buyer is a foreign person as defined by section 205A of the Duties Act 2008, then the Promotion excludes Home and Land.
  5. The Promotion contemplates Nicheliving discounting the value of any Eligible Property under an Eligible Contract by an amount determined by reference to the transfer duty that would have been payable on the Eligible Contract based on the purchase price of the Eligible Property prior to any deduction made under this Promotion (Applicable Transfer Duty).
  6. The maximum discount that Nicheliving will apply to any Eligible Property on account of the value of Applicable Transfer Duty is $10,000 or 25% remaining from the 75% Stamp Duty Rebate but to a maximum value of $10,000 and offer only available with full asking price as advertised and does not apply to offers below asking price.
  7. This Promotion does not apply in conjunction with any other offer made by Nicheliving or its related bodies corporate.
  8. This Promotion is not open to employees of Nicheliving or its related bodies corporate, or any member of their immediate family.
