The following terms and conditions are issued by Australian Property Alliance Pty Ltd (Nicheliving) and apply to the Stamp Duty promotion being offered by Nicheliving (Promotion):
This Promotion commences on 30th October 2019 and ends on 1st May 2020 (or such other date determined by Nicheliving in its absolute discretion) (Promotion Period).
This Promotion applies in respect of contracts entered into during the Promotion Period (Eligible Contract) for the sale and purchase of the following categories of Nicheliving properties: (a) Nicheliving off-the-plan apartments for a new residential unit or apartment in a multi-tiered structure (being a vertical development other than a single-tier strata scheme as defined by section 3(1) of the Strata Titles Act 1985 (Off-the-plan Apartment); and (b) selected Nicheliving home and land packages as determined in Nicheliving’s absolute discretion as a property to which this Promotion applies and as confirmed in writing by Nicheliving to the Buyer at the date of entry into an Eligible Contract, (each an Eligible Property).
The Promotion is available to the buyer of an Eligible Property under an Eligible Contract, if the buyer is a foreign person as defined by section 205A of the Duties Act 2008 (Eligible Buyer), then the promotion only applies to selected apartment dwellings and not house and land. (Eligible Buyer).
The Promotion contemplates Nicheliving discounting the value of any Eligible Property under an Eligible Contract by an amount determined by reference to the transfer duty that would have been payable on the Eligible Contract based on the purchase price of the Eligible Property prior to any deduction made under this Promotion (Applicable Transfer Duty).
The key terms of the Promotion are as follows:Nicheliving will, in respect of any Eligible Contract entered into for any Eligible Property by an Eligible Buyer, discount the purchase price of the Eligible Property by an amount equal to: i. Nicheliving will, in respect of any Eligible Contract entered into for any Eligible Property by an Eligible Buyer, discount the purchase price of the Eligible Property by an amount equal to: ii. 100% of the value of the Applicable Transfer Duty where the Eligible Property is an Off-the-plan Apartment and Nicheliving determines that the Eligible Buyer would not otherwise be eligible for an off-the-plan duty rebate offered by the Office of State Revenue in Western Australia; and iii. in all other cases, 25% of the Applicable Transfer Duty. iv. This maximum discount that Nicheliving will apply to any Eligible Property on account of the value of Applicable Transfer Duty is $10,000
This Promotion does not apply in conjunction with any other offer made by Nicheliving or its related bodies corporate.

Terms and Conditions of “Nicheliving’s up to 55k ofSupport / Stimulus Promotion / Get The Grants / FREE STAMP DUTY” (Promotion)
Promotion 1.1. Promotion: Nicheliving’s up to 55k Get The Grants and Free Stamp Duty 1.2. Promotor: Australian Property Alliance Pty Ltd (ACN 102 889 896) of 180 Newcastle Street, PERTH WA 6000 (Promotor), a subsidiary of Nicheliving Holdings Limited (NLH) 1.3. Promotion Period: The Promotion commences on 4 June 2020 and ends on 31 December 2020 as amended at the Promotor’s absolute discretion (Promotion Period).

Eligibility 3.1. The Promotion is open to persons that are residents of Western Australia and at least 18 years of age or as otherwise determined by the Promotor in its absolute discretion (Eligible Applicant). 3.2. Eligible Applicants enter the Promotion on these T&Cs.
How to participate in the Promotion 4.1. To participate in this Promotion, an Eligible Applicant must, during the Promotion Period: Apartment promotion (a) enter into an agreement to purchase an eligible property at Nicheliving’s Sky Homes Inglewood Apartment Development, as determined by the Promoter in its absolute discretion; and (b) provide evidence to the Promoter (in its absolute satisfaction) establishing the Eligible Applicant’s eligibility to receive: (i) a $25,000 grant from the Commonwealth Government’s HomeBuilder Scheme, (ii) a $10,000 grant from the Western Australian State Government’s First Home Owner Grant; and (iii) the Western Australian State Government’s First Home Owner Rate of Duty, (collectively the Apartment Grants); and (c) apply for the Apartment Grants; and (d) complete on the purchase and settlement of an Apartment (Apartment Settlement). (e) apply for the Government’s stamp duty rebate offer
Benefit under thePromotion 5.1. The Promotion facilitates each Eligible Applicant purchasing: (a) an Apartment, to receive as a participant in the Promotion a financial incentive equal to a value of $20,000, (the Benefit). 5.2. The maximum value an Eligible Applicant participating in the Promotion can receive from the Benefit for purchasing: (a) an Apartment is $20,000 in aggregate. 5.3. The maximum value an Eligible Applicant participating in the Promotion can receive collectively from the Benefit and the Apartment Grants is $55,000 in aggregate. 5.4. Any applicable Benefit under clause 5.1, will be provided to the Eligible Applicant at the relevant Apartment Settlement through an adjustment of the purchase price payable on the relevant Apartment and will be provided in accordance with these T&Cs. 5.5. Any applicable Benefit under clause 5.1, may not be converted into cash or any other form of tender. 5.6. Only one Promotion may be applied to any one Apartment. 5.7. A financial incentive, equal to the stamp duty payable on the sales contract for the Property, payable either as a cash payment or rebated against the balance of the purchase price (at the Promoter’s election) on Settlement. Offer available to eligible apartment applicants. Noting where there is government assistance and the applicant does not have to pay stamp duty – the promoter will not pay again as there is no stamp duty required. In the instance where a second home buyer or investor has to pay the stamp duty only off the plan apartments will be eligible for this offer; if the applicant receives government assistance for off the plan property such as a 75% rebate – the offer will only be limited to the remaining required balance of stamp duty in this example being 25% and not the total amount of stamp duty due to only a 25% fee would be required from the applicant. 5.8. The Benefit is not transferable.
General Conditions 6.1. Each Eligible Applicant agrees to be bound by these T&Cs. 6.2. Without effecting the validity of any applicable Benefit as at the date of termination, the Promotor may terminate this Promotion at any time without further notice to Eligible Applicants. 6.3. If there is any inconsistency between these T&Cs and any other published information in relation to the Promotion, these T&Cs will prevail to the extent of the inconsistency. 6.4. This Promotion and the provision of the Benefit is not transferable. 6.5. An Eligible Applicant may only enter this Promotion once. 6.6. All entries become the property of the Promoter. The Promoter may collect personal information about you for the purposes of the Promotion which will be maintained in accordance with applicable law. 6.7. This Promotion does not apply in conjunction with any other offer made by NLH or its related bodies corporate. 6.8. This Promotion is not open to employees of NLH or its related bodies corporate, or any member of their immediate family. 6.9. The terms of NLH’s or its related bodies corporate Privacy Policies apply to this Promotion. 6.10. These terms are governed by the laws of Western Australia. 6.11. The Promoter, NLH, their related bodies corporate, directors, officers, employees, contractors or consultants disclaim all liability for any loss or damage which is suffered or sustained by an Eligible Applicant or any third party arising out of or in connection with the Promotion.
